Domain Registration Agreement

1. Parties and Scope

This Domain Services Agreement ("Agreement") is between BullerTech, LLC ("BullerTech," "we," "us," or "our"), a Washington limited liability company, and you, the individual or entity purchasing domain registration services through BullerTech ("you" or "your").

BullerTech offers domain registration services as a reseller of Namecheap, Inc. ("Namecheap"), an ICANN-accredited domain registrar. By purchasing domain services through BullerTech, you acknowledge that your domain registration is processed through Namecheap and that you are bound by both this Agreement and the Namecheap Domain Registration Agreement referenced in Section 3 below.

2. BullerTech's Role

BullerTech acts as a reseller and authorized agent for domain registration services. We are not an ICANN-accredited registrar and do not represent ourselves as such. The underlying registrar of record for domains registered through BullerTech is Namecheap, Inc.

BullerTech's role includes:

Facilitating domain registration, renewal, and transfer requests on your behalf
Managing your domain account within our systems
Providing support for domain-related inquiries
Serving as your primary point of contact for domain services

BullerTech does not control registry-level decisions, ICANN policies, or the actions of Namecheap with respect to your domain registration. We will, however, act in good faith to advocate on your behalf in the event of a dispute or service issue with Namecheap or a registry.

3. Namecheap Registration Agreement

Because your domain is registered through Namecheap, you are also bound by the Namecheap Domain Registration Agreement, which governs the underlying registrar relationship, including but not limited to:

Domain registration terms and conditions
Prohibited uses
WHOIS accuracy requirements
Dispute resolution (UDRP)
Expiration, redemption, and deletion procedures
Refund and cancellation policies
Limitation of liability

You agree to review and comply with that agreement. In the event of any conflict between this Agreement and the Namecheap Registration Agreement on matters governed by Namecheap as registrar, the Namecheap Registration Agreement controls.

4. Fees and Payment

BullerTech will provide you with applicable pricing for domain registration, renewal, and transfer services at the time of your order. Fees are due prior to service activation and are subject to change with reasonable notice.

All refund and cancellation rights are governed by Namecheap's then-current refund policy. BullerTech does not independently issue refunds for domain registration fees beyond what Namecheap makes available to us as a reseller. If you believe you are entitled to a refund, contact us and we will initiate the request with Namecheap on your behalf.

BullerTech may charge separate service fees for administrative tasks such as domain transfers, account management, or troubleshooting performed on your behalf. Such fees, if any, will be disclosed to you in advance.

5. Your Responsibilities

You are responsible for:

Providing accurate and current contact information for WHOIS records and your BullerTech account
Keeping your billing information up to date to ensure timely domain renewal
Monitoring your registered email address for notices related to your domain
Ensuring your use of any registered domain complies with applicable laws and the Namecheap Registration Agreement
Renewing your domain registration prior to expiration if you wish to retain it

BullerTech will make reasonable efforts to notify you of upcoming domain expirations, but timely renewal remains your responsibility. BullerTech is not liable for domain loss resulting from failure to renew.

6. Third-Party Registrations

If you are registering a domain on behalf of a third party (such as a client of yours), you represent that:

You are authorized to act as that party's agent
You have informed the third party that their domain is being registered through Namecheap as the underlying registrar
You have obtained the third party's consent to the collection and use of their information as required by the Namecheap Registration Agreement and applicable law

You remain responsible for all obligations under this Agreement with respect to any domain registered on a third party's behalf.

7. WHOIS Privacy

Namecheap provides WHOIS privacy protection by default through its "Withheld for Privacy" service, which masks your personal contact information in the public WHOIS database. By requesting that BullerTech disable WHOIS privacy on your behalf, you acknowledge that your contact information will become publicly visible and that you are providing consent on behalf of all contacts listed in the relevant WHOIS record.

8. Limitation of Liability

BullerTech's liability to you in connection with domain registration services is limited to the fees you paid to BullerTech for the specific domain registration at issue. BullerTech is not liable for actions or omissions of Namecheap, ICANN, or any registry operator, including domain suspension, cancellation, transfer, or expiration.

BullerTech is not liable for any indirect, special, incidental, or consequential damages arising out of or related to domain registration services, including lost business, lost revenue, or loss of data.

9. Indemnification

You agree to defend, indemnify, and hold harmless BullerTech and its members, officers, employees, and agents from any claims, damages, costs, and expenses (including reasonable attorney's fees) arising out of your use of domain registration services, your violation of this Agreement or the Namecheap Registration Agreement, or your infringement of any third party's rights in connection with a registered domain name.

10. Governing Law

This Agreement is governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved in the state or federal courts located in Washington State, and you consent to personal jurisdiction in those courts.

This choice of law applies to the relationship between you and BullerTech only. Disputes involving Namecheap as registrar are governed by the Namecheap Registration Agreement, which designates Arizona law and jurisdiction.

11. Changes to This Agreement

BullerTech may update this Agreement from time to time. We will post the updated version on our website with a revised "Last Updated" date. Your continued use of domain services following a posted update constitutes acceptance of the revised terms.
